Terms of Service

1. Acceptance of Terms

By accessing or using the Ivysion platform, including our website, applications, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

If you are under 18 years of age, you must have a parent or legal guardian review and agree to these Terms on your behalf before using the Service. By allowing a minor to use the Service, the parent or guardian agrees to be bound by these Terms and to be responsible for the minor's use of the platform.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. User Accounts

To access certain features of the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Each user may maintain only one account. Parent and student accounts may be linked to share relevant information in accordance with our Privacy Policy. You may not share your account credentials with any third party or allow others to access your account.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false or misleading information, or are used for unauthorized purposes.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service to:

  • Submit false, misleading, or fraudulent information, including fabricated academic records, test scores, or application materials.
  • Harass, abuse, or threaten other users, including advisors, students, or staff.
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or systems connected to the Service.
  • Use automated tools, bots, scrapers, or similar technologies to access the Service without our prior written consent.
  • Reproduce, distribute, or commercially exploit any content or materials from the Service without authorization.
  • Use the AI features to generate content intended to be submitted as your own original work in college applications, essays, or other academic submissions.

4. AI-Generated Content

The Service includes AI-powered features such as college matching, essay feedback, timeline generation, and chat-based guidance. These features are designed to assist and inform your college admissions process. It is important that you understand the following:

AI provides guidance, not guarantees. College match probabilities, recommendations, and suggestions generated by our AI are based on historical data and algorithmic analysis. They do not guarantee admission to any institution, receipt of financial aid, or any specific outcome. Admissions decisions are made solely by the colleges and universities to which you apply.

AI does not write your essays. Our essay assistant provides feedback, suggestions, and structural guidance on your writing. It does not generate essays or application content on your behalf. You are solely responsible for the originality and authenticity of all materials submitted in your college applications. Using AI-generated text as your own in college applications may violate the policies of the institutions to which you apply.

AI recommendations are reviewed by humans. All AI-generated college recommendations and strategic advice are reviewed and approved by your assigned advisor before being presented to you. However, neither Ivysion nor its advisors guarantee the accuracy or completeness of any AI-generated content.

5. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are owned by Ivysion, Inc. and are protected by copyright, trademark, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of all content you submit to the Service, including essays, academic records, and personal statements. By submitting content, you grant Ivysion a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing the Service to you. We will not use your content for any other purpose without your explicit consent.

6. Advisor Services

Ivysion connects students with experienced college admissions advisors. Advisors are independent professionals who provide guidance based on their expertise and experience. While we carefully vet and monitor all advisors on our platform, the advice they provide represents their professional opinions and should not be considered a guarantee of any outcome.

Advisors are prohibited from making guarantees regarding admission to specific institutions, completing application materials on behalf of students, or engaging in any activity that violates the ethical guidelines of the college admissions profession. If you believe an advisor has acted inappropriately, please contact us immediately.

7. Payment Terms

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan selected. All fees are quoted in U.S. dollars unless otherwise specified. Prices are subject to change with 30 days' notice.

Payment is processed through our third-party payment provider, Stripe. By providing your payment information, you authorize us to charge the applicable fees to your selected payment method. You are responsible for keeping your payment information up to date. Failed payments may result in suspension of access to paid features.

For B2B customers (schools and districts), payment terms are governed by the separate enterprise agreement executed between the institution and Ivysion.

8. Refund Policy

We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with the Service within the first 14 days of your initial subscription, you may request a full refund by contacting us at legal@ivysion.ai. Refunds will be processed to the original payment method within 10 business days.

After the 14-day guarantee period, subscription fees are non-refundable. If you cancel your subscription, you will retain access to paid features until the end of your current billing period. No partial refunds are issued for unused portions of a billing period.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Ivysion and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the total amount paid by you to Ivysion during the twelve months preceding the claim. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

Ivysion does not guarantee admission to any educational institution, receipt of scholarships or financial aid, or any specific academic or admissions outcome. The Service is provided as a guidance tool and should be used as one of many resources in your college admissions journey.

10. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in San Francisco, California, or at another mutually agreed location. The arbitrator's decision shall be final and binding. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Ivysion.

11. Termination

You may terminate your account at any time through your account settings or by contacting us at legal@ivysion.ai. Upon termination, your right to use the Service will immediately cease. We will retain your data in accordance with our Privacy Policy and applicable law.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. In the event of termination for cause, no refund of prepaid fees will be issued.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will notify you by email and/or by posting a notice on the platform at least 30 days before the effective date. We will also update the “Last updated” date at the top of this page.

It is your responsibility to review these Terms periodically. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
